These Terms & Conditions (“Terms”) govern your access to and use of the website https://fandsmasonry.com/ (the “Site”) and any related services, content, forms, or communications provided by Father & Son Masonry, Inc. (“Father & Son Masonry,” “FSM,” “we,” “us,” or “our”).

By accessing or using the Site, requesting a bid, submitting plans or scope documents, or otherwise communicating with us through the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use the Site or request services. By using the Site, you represent and warrant that you meet these requirements.

3. Use of the Site

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:

  • Use the Site in violation of any applicable law, regulation, or third-party right;
  • Submit false, misleading, or fraudulent information through any form on the Site;
  • Upload or transmit any virus, malware, or harmful code;

4. Bids, Estimates, and No Contract Formation Online

Information presented on the Site, including descriptions of services, project examples, FAQs, and blog content, is provided for informational purposes only and does not constitute an offer or contract.

Submitting a bid request, contact form, or project plans through the Site does not create a contract between you and Father & Son Masonry. Any work, pricing, scope, schedule, materials, and warranty terms are governed solely by a separate written agreement, bid, or contract signed by an authorized representative of Father & Son Masonry. Until such a written agreement is executed, no obligation to perform work or hold pricing exists.

Bids and estimates are valid only for the time period stated on the bid document and are subject to revision based on changes in scope, site conditions, material availability, code requirements, or other factors.

5. Project Submissions and Confidentiality

When you submit plans, drawings, scope documents, photos, or other files through the Site (including via the “Attach file” feature), you represent and warrant that:

  • You have the legal right to share those materials with us;
  • Sharing the materials does not violate any third-party intellectual property, confidentiality, or contractual obligation;
  • You grant Father & Son Masonry a limited, non-exclusive license to use, copy, and distribute those materials internally and with project partners (engineers, suppliers, subcontractors, permitting authorities) solely for the purpose of estimating, bidding, coordinating, and performing the work.

We treat submitted plans and project documents as confidential and use them only for the purposes described above and in our Privacy Policy.

6. Intellectual Property

All content on the Site — including text, graphics, logos, photos, project images, blog articles, FAQs, and the overall “look and feel” — is the property of Father & Son Masonry or its licensors and is protected by United States and international intellectual property laws.

You may view and print pages from the Site for your personal, non-commercial use. Any other use, including reproduction, modification, distribution, public display, or use for commercial purposes, requires our prior written consent.

“Father & Son Masonry,” the FSM logo, and any related names and marks are trademarks of Father & Son Masonry, Inc. You may not use them without our prior written permission.

Blog articles, FAQs, and other educational content on the Site (including topics such as permits, retaining walls, HOA requirements, caliche soils, and contractor selection) are provided for general informational purposes only.

This content does not constitute engineering, legal, code-compliance, structural, or professional advice and should not be relied on as such. Project-specific requirements vary based on site conditions, jurisdiction, plans, and applicable codes. Always consult a licensed professional and the appropriate permitting authority before making decisions about your project.

8. Licensing and Scope of Services

Father & Son Masonry is licensed in Arizona under ROC KB-1 361725, ADOG V100394, and ROC K-31 172071. We perform only the scopes of work permitted under our licenses and applicable Arizona Registrar of Contractors (ROC) regulations.

Listing services on the Site does not guarantee availability in every location, for every project type, or at any particular time. All projects are subject to scope review, scheduling, and capacity confirmation.

9. Warranty

Completed projects are backed by Arizona’s standard ROC 2-year workmanship warranty, applicable to labor and structural craftsmanship as required by the Arizona Registrar of Contractors. The specific terms, scope, exclusions, and procedures for warranty claims are governed by the written contract for the applicable project and by Arizona ROC rules.

Except for the warranty described above and any warranties expressly provided in a signed written contract, Father & Son Masonry makes no other warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Disclaimers

The Site and all content on it are provided “as is” and “as available,” without warranties of any kind, either express or implied. To the fullest extent permitted by law, Father & Son Masonry disclaims all warranties relating to the Site, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, or that any defects will be corrected. Your use of the Site is at your sole risk.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Father & Son Masonry, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Site, including, without limitation, damages for lost profits, lost data, business interruption, or any other intangible loss, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or related to your use of the Site shall not exceed one hundred U.S. dollars (US $100). Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

This Section does not apply to or limit liability under any signed construction contract between you and Father & Son Masonry, which is governed by its own terms.

12. Indemnification

You agree to defend, indemnify, and hold harmless Father & Son Masonry, its owners, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way related to:

  • Your use or misuse of the Site;
  • Your violation of these Terms;
  • Your violation of any applicable law or third-party right;
  • Any content, plans, files, or information you submit through the Site.

The Site may contain links to third-party websites, services, or resources (including suppliers, partners, BBB, and review platforms) that are not operated by us. We are not responsible for the content, accuracy, policies, or practices of any third-party sites. Accessing third-party sites is at your own risk.

14. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the practices described in the Privacy Policy.

17. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.

18. Arbitration of Construction Disputes

Disputes arising out of a signed construction contract between you and Father & Son Masonry are governed by the dispute-resolution terms of that contract and by applicable Arizona ROC procedures. Nothing in these Terms limits your right to file a complaint with the Arizona Registrar of Contractors regarding licensed contractor work.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.

20. Entire Agreement

These Terms, together with our Privacy Policy and any signed written contract for services, constitute the entire agreement between you and Father & Son Masonry regarding your use of the Site, and supersede any prior agreements or understandings regarding that subject matter.

21. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision. A waiver is effective only if it is in writing and signed by an authorized representative of Father & Son Masonry.

22. Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of all or part of our business.
